Terms of hire

These terms apply when Ceylon Cars (Pvt) Ltd hires a vehicle to you. The quotation we send you, together with the signed hire agreement you complete when you collect the vehicle, forms the contract between us. Where the hire agreement and these terms differ, the hire agreement applies.
1. Who may drive
Only a person named on the hire agreement may drive the vehicle. Each named driver must be at least 21 years old, must have held a licence for at least twelve months, and must hold a licence that is valid in Sri Lanka at the time of the hire.
A licence issued outside Sri Lanka must be recognised locally before it may be used to drive here. Obtaining that recognition is the hirer’s responsibility. We will tell you what it requires and we can help you arrange it, but we cannot release a vehicle to a driver who does not hold it.
If a person who is not named on the agreement drives the vehicle, the insurance does not cover the vehicle for that period and the hirer is liable for all resulting loss.
2. Deposit
A refundable deposit of LKR 25,000 is payable before the vehicle is released. It is held against damage, loss, traffic offences, unpaid charges and any breach of these terms.
The deposit is returned once the vehicle has been inspected on return and any outstanding traffic notices have cleared. Where a deduction is made, we will set out what it is for and what it cost.
3. Insurance and excess
Every vehicle carries comprehensive insurance for the period of the hire. An excess applies to each claim; the amount is stated on the vehicle’s page and repeated in your quotation.
The insurance does not cover:
- damage caused while a driver was under the influence of alcohol or drugs
- damage caused by a driver not named on the hire agreement
- damage to the underside, tyres, wheels or glass, unless a separate cover has been agreed
- damage caused off a public road, or on a road the vehicle is not suited to
- loss of or damage to anything left in the vehicle
4. Fuel
The vehicle is supplied with a full tank and must be returned with a full tank. Where it is not, we charge the fuel at cost. We do not add a refuelling fee.
5. Distance
Each vehicle includes a daily distance allowance, between 100 and 150 kilometres depending on the vehicle, averaged across the hire. Distance beyond the allowance is charged at the per-kilometre rate shown on the vehicle’s page.
6. Condition, damage and breakdown
We photograph the vehicle with you at handover and again on return. Those photographs are the record of its condition, and both parties receive a copy.
Roadside assistance is included for the duration of the hire. If the vehicle becomes unusable through no fault of the hirer, we will replace it where we can, or refund the unused part of the hire.
The hirer must not attempt repairs, and must not authorise repairs by anyone else, without our agreement.
7. Traffic offences and fines
The hirer is responsible for any traffic offence committed during the hire, and for any fine, court fee or administrative charge arising from it, whenever it is notified to us.
8. Changes and cancellation
Tell us as early as you can. We will always try to accommodate a change of dates. The notice period required for a cancellation without charge, and the charge that applies inside it, are stated in your quotation.
9. Prohibited use
The vehicle must not be used:
- to carry passengers or goods for hire or reward
- to push or tow another vehicle
- in a race, rally, or any form of competition
- to carry more people than it has seatbelts for
- outside Sri Lanka
10. Liability
We are liable for loss caused by our own failure to meet these terms. We are not liable for indirect or consequential loss, including missed connections, lost bookings or lost earnings, except where the law does not allow that limit.
Nothing here limits liability for death or personal injury caused by negligence.

12. Law
These terms are governed by the law of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute arising from them.
